Terms of Use

Legal agreement outlining user responsibilities and service conditions for Boardwalk

1. Scope and Application

1.1. These Terms of Use apply to all users accessing services operated under a valid Bookmaker Licence or Casino Licence issued by a Provincial Gambling Board in South Africa, including but not limited to Gauteng Gambling Board, Western Cape Gambling and Racing Board, and North West Gambling Board.

1.2. Covered services include sports betting, horse race betting, and online betting activities permitted by provincial law. Online casino games such as slots, blackjack, and roulette are prohibited under national law except where specifically authorised by provincial regulation or conditions of bookmaker licences.

1.3. Use of services from outside South Africa or from any province without a valid licence is prohibited. Registration and wagering by such users is not permitted.

2. Eligibility and Account Registration

2.1. Only users aged 18 or older may register or use services. Proof of age and identity may be requested at any time. Non-compliance will result in suspension.

2.2. Registration must include accurate personal details, including full name, date of birth, residential address, and contact information. The provision of false or misleading information is a breach and may lead to account closure and forfeiture of funds.

2.3. Each user may register one account only. Multiple accounts per individual are not allowed; any duplicate accounts and associated winnings may be voided.

2.4. User identity is subject to Anti-Money Laundering (AML) and Know Your Customer (KYC) checks as required by the Financial Intelligence Centre Act and relevant provincial regulations.

3. Prohibited Activities

3.1. Users must not engage in money laundering, fraud, collusion, or manipulative activity aimed at affecting service outcomes or exploiting system vulnerabilities.

3.2. Use of restricted jurisdictions, VPNs to circumvent geographic limitations, or registration by individuals listed on the National Central Exclusion Register is strictly forbidden.

3.3. Underage gambling is illegal. Any suspected underage gambling will be reported to the applicable Provincial Gambling Board.

4. Betting Rules and Limits

4.1. Wagers are subject to operator acceptance. The operator may refuse or limit wagers at its sole discretion without prior notice.

4.2. Payouts are based on gross gambling revenue (GGR) and subject to provincial taxes, varying between 6.5% for bookmakers and 10-15% for casino operations.

4.3. Users must ensure compliance with any deposit, loss, or session time limits set by themselves or imposed by the operator, in accordance with responsible gambling obligations.

5. Responsible Gambling Obligations

5.1. The operator provides users with options for self-exclusion, deposit limits, and access to the National Central Exclusion Register in line with provincial responsible gambling requirements.

5.2. Users seeking exclusion from services may request either temporary or permanent barring by contacting the operator or registering with the National Central Exclusion Register maintained by the National Gambling Board.

5.3. Wagers from self-excluded individuals or those listed on exclusion registers are not accepted. Detection of such activity will result in immediate account closure and forfeiture of funds.

6. Account Suspension and Termination

6.1. The operator may suspend or terminate accounts for violations of these Terms of Use, failure to fulfil verification requirements, suspected fraud, or breach of relevant laws.

6.2. Upon account termination, any remaining balance will be returned to the user, subject to completion of verification and compliance checks. Funds related to voided wagers or prohibited activity will not be returned.

6.3. Users may close their account by written request. Fund withdrawal is subject to completion of outstanding wagers and verification.

7. Compliance with National and Provincial Law

7.1. These Terms of Use are governed by the National Gambling Act 7 of 2004 and the laws of the licensing province, including but not limited to the Gauteng Gambling Act 4 of 1995, Western Cape Gambling and Racing Act 4 of 1996, and KwaZulu-Natal Gaming and Betting Act.

7.2. Operator activities are subject to audit and enforcement by the relevant Provincial Gambling Board and the National Gambling Board. Users are required to cooperate with regulatory investigations.

7.3. Legislative changes, including proposed Remote Gambling Bill and the 2025 Supreme Court ruling on casino-style games under bookmaker licences, may result in amendments. Users will be notified of material changes. Use of services after such notifications constitutes acceptance.

8. Data Protection and Privacy

8.1. Personal data is collected and processed in accordance with the Protection of Personal Information Act 4 of 2013 and provincial regulations.

8.2. User data may be shared with Provincial Gambling Boards, the National Gambling Board, and law enforcement authorities as required for legal compliance, fraud prevention, or investigations into underage gambling.

8.3. Users may request access, correction, or deletion of their personal data, subject to legal retention obligations.

9. Limitation of Liability

9.1. The operator is not liable for losses caused by user error, technical malfunctions, or events beyond reasonable control.

9.2. Uninterrupted service access is not guaranteed. Operations may be suspended for maintenance, compliance, or other operational requirements.

10. Amendments

10.1. These Terms of Use may be amended at any time to reflect legal, regulatory, or operational changes. Updated terms will be published on the operator’s website and users notified by registered email or account alerts.

10.2. Continued service use following amendments constitutes acceptance. Users not consenting to changes must close their account.

11. Governing Law and Dispute Resolution

11.1. These Terms of Use are governed by the laws of South Africa and of the province in which the operator is licensed.

11.2. Disputes must be addressed in accordance with the dispute resolution process of the relevant Provincial Gambling Board before court proceedings may be initiated.
